Mueller Team Criticized By Fellow Attorneys For History Of Questionable Tactics

Special Counsel Robert Mueller and his team running the Russia collusion probe are being accused by fellow attorneys of employing aggressive and questionable tactics in past cases, potentially putting a dent in his straight-shooter image.

As the investigation heats up and key players like former White House chief of staff Reince Priebus and press secretary Sean Spicer are interviewed by investigators, several attorneys with experience in federal cases spoke out with their concerns this week.

Harvey Silverglate, a criminal defense attorney in Massachusetts, wrote an opinion piece accusing Mueller of once trying to entrap him when Mueller was acting U.S. attorney in Boston.

"I have known Mueller during key moments of his career as a federal prosecutor," Silverglate wrote for WGBH News. "My experience has taught me to approach whatever he does in the Trump investigation with a requisite degree of skepticism or, at the very least, extreme caution."

According to Silverglate, Mueller once sent someone into Silverglate's office offering to give false testimony for a client. Silverglate said he turned the offer down and noticed the man was wearing a wire.

"Years later I ran into Mueller, and I told him of my disappointment in being the target of a sting where there was no reason to think that I would knowingly present perjured evidence to a court," Silverglate wrote. "Mueller, half-apologetically, told me that he never really thought that I would suborn perjury, but that he had a duty to pursue the lead given to him."

A spokesman for the special counsel's office declined to comment.

Sidney Powell, a former federal prosecutor, also took aim at Andrew Weissmann, the prosecutor tapped by Mueller to help lead the investigation, in a piece this week titled, "Judging by Mueller's staffing choices, he may not be very interested in justice."

Powell accused Weissmann, once the director of the Enron Task Force, of "prosecutorial overreach" in past cases and said it could signal what's to come for President Trump and his associates in the Russia probe.

"What was supposed to have been a search for Russia's cyberspace intrusions into our electoral politics has morphed into a malevolent mission targeting friends, family and colleagues of the president," Powell wrote in The Hill. "The Mueller investigation has become an all-out assault to find crimes to pin on them -- and it won't matter if there are no crimes to be found. This team can make some.

Powell cited several cases where Weissmann won convictions that were later overturned.

Where the Russian uranium scandal might lead

Before the Obama administration approved Russia's acquisition of more than 20 percent of America's uranium supply, the Federal Bureau of Investigation found Russian racketeering involved.

This shocking news is in a must-read investigation by reporters John Solomon and Alison Spann in The Hill on October 17.

"Russian nuclear officials had routed millions of dollars to the U.S. designed to benefit former President Bill Clinton's charitable foundation during the time Secretary of State Hillary Clinton served on a government body that provided a favorable decision to Moscow," sources told Solomon and Spann.

But acting FBI investigators at the time - including then-U.S. attorney Rod Rosenstein and Robert Mueller, the man Rosenstein would later choose to investigate possible Russian collusion that helped Donald Trump win the 2016 election - apparently did not share this information about Russia with key members of Congress.

Solomon, Spann, and The Hill might win a Pulitzer Prize for their excellent investigative reporting...if it incriminated Republicans. But since it instead found potential wrongdoing by Democrats, the mainstream media will either ignore or find fault with it.

This investigation points to important issues it does not spell out, so we shall use it as a stepping stone to touch on three of them:

1. The new investigation clearly indicates that Mueller and Rosenstein knew of Russian millions paid to Bill and Hillary Clinton's foundation. This foundation served as a slush fund that paid for some of her political activities and subsidized her campaign staff before 2016.

This is a priori evidence of Russian influence in American politics - in the form of more than $145 million funneled by Russia to the Clintons. Ms. Clinton ran for president in 2008 and was clearly positioning herself to run again in 2016.

Yet Mueller persists in not investigating Ms. Clinton as a suspect in his fishing expedition that seeks some crime of "election collusion by Russia," yet to be found, committed only by President Trump. Can Mueller continue stonewalling after this new evidence?

FBI uncovered Russian bribery plot before Obama administration approved controversial nuclear deal with Moscow

Before the Obama administration approved a controversial deal in 2010 giving Moscow control of a large swath of American uranium, the FBI had gathered substantial evidence that Russian nuclear industry officials were engaged in bribery, kickbacks, extortion and money laundering designed to grow Vladimir Putin's atomic energy business inside the United States, according to government documents and interviews.

Federal agents used a confidential U.S. witness working inside the Russian nuclear industry to gather extensive financial records, make secret recordings and intercept emails as early as 2009 that showed Moscow had compromised an American uranium trucking firm with bribes and kickbacks in violation of the Foreign Corrupt Practices Act, FBI and court documents show.

They also obtained an eyewitness account -- backed by documents -- indicating Russian nuclear officials had routed millions of dollars to the U.S. designed to benefit former President Bill Clinton's charitable foundation during the time Secretary of State Hillary Clinton served on a government body that provided a favorable decision to Moscow, sources told The Hill.

The racketeering scheme was conducted "with the consent of higher level officials" in Russia who "shared the proceeds" from the kickbacks, one agent declared in an affidavit years later.

Rather than bring immediate charges in 2010, however, the Department of Justice (DOJ) continued investigating the matter for nearly four more years, essentially leaving the American public and Congress in the dark about Russian nuclear corruption on U.S. soil during a period when the Obama administration made two major decisions benefitting Putin's commercial nuclear ambitions.

The first decision occurred in October 2010, when the State Department and government agencies on the Committee on Foreign Investment in the United States unanimously approved the partial sale of Canadian mining company Uranium One to the Russian nuclear giant Rosatom, giving Moscow control of more than 20 percent of America's uranium supply.

"The Russians were compromising American contractors in the nuclear industry with kickbacks and extortion threats, all of which raised legitimate national security concerns. And none of that evidence got aired before the Obama administration made those decisions," a person who worked on the case told The Hill, speaking on condition of anonymity for fear of retribution by U.S. or Russian officials.

But FBI, Energy Department and court documents reviewed by The Hill show the FBI in fact had gathered substantial evidence well before the committee's decision that Vadim Mikerin -- the main Russian overseeing Putin's nuclear expansion inside the United States -- was engaged in wrongdoing starting in 2009.

Then-Attorney General Eric Holder was among the Obama administration officials joining Hillary Clinton on the Committee on Foreign Investment in the United States at the time the Uranium One deal was approved. Multiple current and former government officials told The Hill they did not know whether the FBI or DOJ ever alerted committee members to the criminal activity they uncovered.

Let's put the Uranium One scandal in perspective: The cool half-million bucks the Putin regime funneled to Bill Clinton was five times the amount it spent on those Facebook ads -- the ones the media-Democrat complex ludicrously suggests swung the 2016 presidential election to Donald Trump.

The Facebook-ad buy, which started in June 2015 -- before Donald Trump entered the race -- was more left-wing agitprop (ads pushing hysteria on racism, immigration, guns, etc.) than electioneering. The Clintons' own long-time political strategist Mark Penn estimates that just $6,500 went to actual electioneering. (You read that right: 65 hundred dollars.) By contrast, the staggering $500,000 payday from a Kremlin-tied Russian bank for a single speech was part of a multi-million-dollar influence-peddling scheme to enrich the former president and his wife, then-secretary of state Hillary Clinton. At the time, Russia was plotting -- successfully -- to secure U.S. government approval for its acquisition of Uranium One, and with it, tens of billions of dollars in U.S. uranium reserves.

Here's the kicker: The Uranium One scandal is not only, or even principally, a Clinton scandal. It is an Obama-administration scandal.

The Clintons were just doing what the Clintons do: cashing in on their "public service." The Obama administration, with Secretary Clinton at the forefront but hardly alone, was knowingly compromising American national-security interests. The administration green-lighted the transfer of control over one-fifth of American uranium-mining capacity to Russia, a hostile regime -- and specifically to Russia's state-controlled nuclear-energy conglomerate, Rosatom. Worse, at the time the administration approved the transfer, it knew that Rosatom's American subsidiary was engaged in a lucrative racketeering enterprise that had already committed felony extortion, fraud, and money-laundering offenses.

The Obama administration also knew that congressional Republicans were trying to stop the transfer. Consequently, the Justice Department concealed what it knew. DOJ allowed the racketeering enterprise to continue compromising the American uranium industry rather than commencing a prosecution that would have scotched the transfer. Prosecutors waited four years before quietly pleading the case out for a song, in violation of Justice Department charging guidelines. Meanwhile, the administration stonewalled Congress, reportedly threatening an informant who wanted to go public.

Obama's 'Reset'

Uranium One, Russia, and the Clinton's

There is no doubt that this extraordinarily gainful ingratiation took place. I outlined some of it a year ago in suggesting that the Justice Department should be investigating the Clinton Foundation, and its exploitation of Hillary Clinton's influence as secretary of state, as a potential racketeering case.

In 2005, former President Clinton helped his Canadian billionaire friend and benefactor, Frank Giustra, obtain coveted uranium-mining rights from Kazakhstan's dictator. The Kazakh deal enabled Giustra's company (Ur-Asia Energy) to merge into Uranium One (a South African company), a $3.5 billion windfall. Giustra and his partners thereafter contributed tens of millions of dollars to the Clinton Foundation. Besides the valuable Kazakh reserves, Uranium One also controlled about a fifth of the uranium stock in the United States.

Alas, Putin, the neighborhood bully, also wanted the Kazakh uranium. He leaned on Kazakhstan's dictator, who promptly arrested the official responsible for selling the uranium-mining rights to Giustra's company. This put Uranium One's stake in jeopardy of being seized by the Kazakh government.

As Uranium One's stock plunged, its panicked executives turned to the State Department, where their friend Hillary Clinton was now in charge. State sprung into action, convening emergency meetings with the Kazakh regime. A few days later, it was announced that the crisis was resolved (translation: the shakedown was complete). Russia's energy giant, Rosatom, would purchase 17 percent of Uranium One, and the Kazakh threat would disappear -- and with it, the threat to the value of the Clinton donors' holdings.

For Putin, though, that was just a start. He didn't want a minority stake in Uranium One, he wanted control of the uranium. For that, Rosatom would need a controlling interest in Uranium One. That would be a tall order -- not because of the Kazakh mining rights but because acquisition of Uranium One's American reserves required U.S. government approval.

Uranium is foundational to nuclear power and thus to American national security. As the New York Times explained in a report on the disturbing interplay between the Clinton Foundation and the transfer of American uranium assets to Russia, the United States gets a fifth of its electrical power from nuclear energy, but only produces a fifth of the uranium it needs. Consequently, a foreign entity would not be able to acquire rights to American uranium without the approval of the Committee on Foreign Investment in the United States.

CFIUS is composed of the leaders of 14 U.S. government agencies involved in national security and commerce. In 2010, these included not only Secretary of State Hillary Clinton, who had cultivated a reputation as a hawk opposed to such foreign purchases, but Attorney General Eric Holder, whose Justice Department (and its lead agency, the FBI) were conducting the investigation of Rosatom's ongoing U.S. racketeering, extortion, and money-laundering scheme.

In March 2010, to push the Obama "reset" agenda, Secretary Clinton traveled to Russia, where she met with Putin and Dimitri Medvedev, who was then keeping the president's chair warm for Putin. Soon after, it emerged that Renaissance Capital, a regime-tied Russian bank, had offered Bill Clinton $500,000 to make a single speech -- far more than the former president's usual haul in what would become one of his biggest paydays ever. Renaissance was an aggressive promoter of Rosatom. The Clinton speech took place in Moscow in June. The exorbitant speech fee, it is worth noting, is a pittance compared with the $145 million Newsweek reports was donated to the Clinton Foundation by sources linked to the Uranium One deal.

The month before the speech, the Hill reports, Bill Clinton told his wife's State Department that he wanted to meet while in Russia with Arkady Dvorkovich, who, in addition to being a top Medvedev aide, was also a key Rosatom board member. It is not known whether the State Department gave clearance for the meeting; the question appears to have become moot since the former U.S. president met directly with Putin and Medvedev. You'll be comforted, I'm sure, to learn that aides to the Clintons, those pillars of integrity, assure us that the topics of Rosatom and Uranium One never came up.

DOJ Lifts Gag Order On FBI Informant To Discuss Uranium Deal With Congress

WASHINGTON--The Justice Department late Wednesday lifted a gag order on an FBI informant to provide testimony to Congress about an inquiry linked to a 2010 deal that transferred ownership of uranium mining firm to a Russian-owned company.

The action comes a day after California Rep. Devin Nunes, the Republican chairman of the House Intelligence Committee, announced an investigation into the matter and any role then-Secretary of State Hillary Clinton played in the deal.

"As of tonight, the Department of Justice has authorized the informant to disclose to the chairmen and ranking members of the Senate Committee on the Judiciary, the House Committee on Oversight and Government Reform, and the House Permanent Select Committee on Intelligence, as well as one member of each of their staffs, any information or documents he has concerning alleged corruption or bribery involving transactions in the uranium market," Justice spokesman Ian Prior said.

House Committees Announced An Investigation Into The Uranium One Deal

Republican members of the House Permanent Select Committee on Intelligence announced Tuesday that they, along with the House judiciary and oversight committees, were launching new probes into the Obama administration's approval of the sale of a Canadian company, Uranium One, to Russia's state-owned nuclear giant, Rosatom's Tenex subsidiary.

"So what we're here today to announce is an inquiry into Russia's involvement into the Uranium Deal that was done several years ago," said House Intelligence Committee Chairman Devin Nunes (R-CA). "This is just the beginning of this probe, we are not going to jump to any conclusions at this time; but one of the things, as you know we are concerned about, is whether or not there was an FBI investigation, was there a DOJ investigation, and if so, why was Congress not informed about this matter."

Last week in a formal letter, Senate Judiciary Committee Chairman Charles Grassley (R-IA) asked the (sic) Victoria Toensing, the lawyer representing a former FBI informant who had worked on behalf of the FBI with the Russian uranium companies, to allow her client to testify before the Senate Judiciary Committee about the Russian subsidiary and other connected players.

In the press conference with Nunes, speaking for House Oversight and Government Reform Committee Chairman Trey Gowdy (R-SC), Rep. Ron DeSantis (R-FL) said, "We do have a witness who is a confidential informant who wants to talk about his role in this and we're in contact with the Justice Department to release him from a nondisclosure agreement."

With Clinton's Tied To Scandal, A Triple Deus Ex Machina Descends Upon Washington

It is delicious to see, even more suddenly and completely than anyone had anticipated, the breakdown of the steamroller media smear of Donald Trump. A trinitarian deus ex machina descended.

The Washington Post, struggling desperately in its discomfort, a few days ahead of the information being forcibly extracted by congressional subpoenas, acknowledged that the Clinton campaign and the Democratic National Committee had paid for the assembly of the Steele dossier.

This rotten fish of lies and gossip was universally regarded at first as rubbish so scurrilous no one would publish it for months until Buzzfeed, the bottom of the web barrel, took it up, which emboldened the flounder skimming the bottom, CNN, to present it as a major triumph of journalistic enterprise and to popularize it.

Carl Bernstein, one of America's most Pulitzer-laden myth-makers, was exhumed to pronounce it an important document.

Finally, after everything else had led nowhere, bloodthirsty Trumpophobes like the leaders of the Senate Intelligence Committee, Senators Burr and Warner, acknowledged that Mr. Steele was all they could go on, and they could not get at its sources because of the intervention of special counsel Robert Mueller and Deputy Attorney General Rod Rosenstein, preventing FBI officials from testifying before Congress.

CNN, through the pleasing Erin Burnett, wagging her puckered nose at us, tiresomely repeated that some aspects of the Steele dossier had been "proved," but some were not corroborated, and that the dossier was initiated by Fusion GPS at the request of anti-Trump Republicans, whose place was taken first by the Clinton campaign, when Mr. Trump clinched the Republican nomination, and then by the FBI.

In fact, none of it has been seriously corroborated, and the only part of it with the slightest relevance to Mr. Trump's legitimacy as president is a completely unsubstantiated suggestion that some promises might have been made to alter U.S. policy toward Russia favorably if the Russian government could affect the U.S. election's outcome in Mr. Trump's favor.

There is not a shred of evidence to support this, despite fervent efforts by the Obama administration and the special counsel to unearth some. Nor is there any evidence of actual Russian influence on the election result or of any policy change by the present administration toward Russia that the Kremlin would welcome. Nor, though The New York Times clings to the story, has any evidence surfaced that Fusion GPS was initially retained on this file by anti-Trump Republicans.

It was inexpressibly pleasant to see a CNN "expert" refer to the news that the sole remaining, pitiful wisp of hopeful damage to Trump and support of the collusion canard was this bit of slime bought and paid for by the Clinton campaign as, get ready for it, "A talking point for the Republicans!"

As this hydrogen balloon was blowing up like the Hindenburg at the mast at Lakehurst, New Jersey, the Uranium One affair was boiling over as a new congressional investigation was launched into the whole issue of about $131 million to $145 million being pledged or paid to the Clinton Foundation as Bill Clinton was paid $500,000 for an ordinary speech in Moscow. Secretary of State Clinton and Attorney General Holder agreed to sell 20% of American uranium resources to Russia, through Russian intermediaries then under intensive investigation by the FBI director, Robert Mueller, and by then U.S. attorney in Maryland, Rod Rosenstein.

Larry Klayman Lobbies Trump To Be Hillary Clinton Special Counsel

Conservative legal activist Larry Klayman is petitioning President Trump for an appointment to be special counsel to investigate possible crimes committed by Hillary Clinton and her associates.

Klayman, a colorful litigator with three decades of head-turning pursuits, told the Washington Examiner he will form a "citizen's grand jury" to review evidence against Clinton if Trump doesn't appoint him special counsel by the end of November.

On Monday, after two indictments and a guilty plea in special counsel Robert Mueller's probe of possible Trump ties to Russia, Klayman said signatures were pouring in for his online petition, which he intends to deliver to the Justice Department and the White House.

"I do know a lot of people in and around him. President Trump will get this, and I know he follows what I do," Klayman said. "Trump has the authority to tell [Attorney General] Jeff Sessions to appoint me."

Trump has pointedly criticized what he called Sessions' "very weak" approach toward Clinton. Klayman imagines himself as a second special counsel alongside Mueller, though he also believes Mueller should be fired.

If he can't get the job, Klayman said he will convene a "citizen's grand jury" in Ocala, Fla., to review allegations against Clinton. He imagines an 18-person representative body formed after sending out mailers at random based on voter rolls.

"I'll be, in effect, my own special counsel," he said. "That's the way it used to be done in the Old West."

If Clinton or any of her associates are indicted, Klayman said "then we'll try her and I'll be the prosecutor" and "we'll find a judge who's neutral, maybe a retired judge."

What if Klayman's informal trial sentences her to prison? "I believe the verdict would be valid," he said. "At that point, the executive branch would have to execute on it."
